Terms and conditions
This Tutoring Agreement solidifies the educational partnership between Sue Whitfield Tutoring and the student/guardian with a shared commitment to the terms and conditions governing the tutoring services.
1 - TUTORING SERVICES
1.1 - Subject and Scope: Sue Whitfield Tutoring agrees to provide tutoring services to the student named below. These services will encompass Maths/English/Writing tuition, depending on courses booked.
1.2 - Schedule and Duration: The tutoring sessions will be held on the days and times indicated in the schedule and have a duration as indicated in the schedule.
1.3 - Booking policy: Students/guardians should sign up for courses via email or phone. A copy of the terms and conditions and a student information sheet will then be sent which should be completed and returned electronically. Current students have priority to sign on for a further 6-week block for the “Accelerate” weekly courses. If a course is full, the student will be put on a waiting list until a suitable place becomes available.
2 – FEES & PAYMENT
2.1 - Fee Structure: The fee for tutoring services is as stated on the website, depending on the session booked. The fee includes all tutoring, resources, weekly homework and a progress report, if requested, at the end of each tuition block.
2.2 - Payment Schedule:
a) For weekly sessions: When students sign up for tutoring, the parent/guardian will be invoiced for the cost of the half-termly block (generally 5-6 weeks). Payments are expected in advance with payment due before the first tutoring session begins. Failure to pay the invoice within 10 days may result in the suspension of tutoring services.
b) For Masterclasses and “Headstart” courses: When students sign up for tutoring, the parent/guardian will be invoiced for the cost of the course. Payments are expected in advance, with payment due before the tutoring session begins. Failure to pay invoices within 10 days may result in the suspension of tutoring services.
3 - CANCELLATION POLICY
3.1 - Cancellation by Student/Guardian:
a) For weekly sessions: If a student cannot attend a tutoring session due to illness or absence, please give as much notice as possible via phone or email. The session materials will then be emailed to them, so they can complete the session in their own time. No refund of course fees will be given, except at the discretion of the tutor. If a student/parent wishes to terminate the tutoring agreement part-way through a 6-week block, two weeks’ notice is required and a 50% cancellation fee will apply for any remaining sessions unless the place is filled by another student, in which case a full refund for any remaining sessions will apply.
b) For Masterclasses and “Headstart” courses: If students/guardians cancel with at least 72 hours’ notice, a full refund will be given. Between 48- and 72-hours’ notice will incur a cancellation fee of 50% unless the place is filled by another student, in which case a full refund will apply. For less than 24 hours’ notice, no refund of course fees will be given.
3.2 - Cancellation by Tutor:
If a course is cancelled by the tutor, we will try to rearrange the session on a mutually convenient day/time. If this is not possible, a full refund will be given or, alternatively, credit against future courses.
4 - HOMEWORK & ASSIGNMENTS
4.1 - Homework Assignments: With the agreement of the parent/guardian, the tutor may assign homework, practice exercises, or additional reading materials to enhance the student's understanding of the subject matter. It is expected that the student will complete these assignments in a timely manner.
4.2 - Review of Assignments: The tutor shall review and provide feedback on the completed assignments during the tutoring sessions, offering guidance and clarification as needed.
5 - PROGRESS REPORTS
5.1 - Reporting Period: The tutor shall provide periodic progress reports (verbal or written) to the student/guardian at the end of each 6-week block for “Accelerate” sessions or at the end of each Masterclass or “Headstart” course. These reports will include an evaluation of the student's progress and suggestions for areas for improvement.
6 - MATERIALS & RESOURCES
6.1 - Learning Materials: The tutor will provide educational materials, resources, and content to support the tutoring sessions. These materials remain the property of the tutor and may be used solely for educational purposes.
7 - CODE OF CONDUCT
7.1 - Respectful Behaviour: Both the tutor and the student/guardian are expected to engage in the tutoring process with respect, professionalism, and courtesy. Disruptive, offensive, or disrespectful behaviour will not be tolerated and will result in the suspension of tutoring services.
3.2 - Punctuality: Punctuality is crucial. Both the tutor and the student/guardian agree to be on time for scheduled tutoring sessions, recognizing that tardiness may affect the quality of the session.
8 - TERMINATION
8.1 - Termination by student/guardian: The student/guardian may terminate this tutoring contract at any time by providing prior notice to the tutor. In such cases, the Cancellation Policy as stated in section 3.1 will apply with regard to the refund of fees.
8.2 - Termination by tutor: The tutor may terminate this contract if the student/guardian fails to adhere to the contract terms, exhibits disruptive behaviour, or presents any other impediments to the learning process. In such cases, the tutor will not be obligated to provide any refund of fees but will decide on a case-by-case basis.
9 - CONFIDENTIALITY
9.1 - Privacy: Both the tutor and the student/ guardian agree to respect the confidentiality of all information shared during tutoring sessions, including academic records, progress reports, and any personal information.
9.2 - Data Security: The tutor shall take reasonable measures to ensure the security of any electronic or paper records and data associated with the tutoring sessions, safeguarding them from unauthorized access or disclosure. Please also see Privacy Policy on website.
10 - LIABILITY & RESPONSIBILITY
10.1 - Limitation of Liability: The tutor shall not be held liable for any academic outcomes, grades, or other consequences related to the student's academic performance. The tutor's responsibility is to provide educational support and guidance to the best of their abilities.
10.2 - Accident or Injury: In the event of an accident or injury occurring during a tutoring session, the tutor shall not be held responsible, and the student/guardian releases the tutor from any liability, except in cases of gross negligence or misconduct.
11 - FEEDBACK & COMMUNICATION
11.1 - Feedback: The tutor and the student/guardian agree to provide constructive feedback to each other regarding the tutoring sessions and the learning experience. Feedback can be conveyed in writing, during sessions, or through other agreed-upon means.
11.2 - Communication: Communication between the tutor and the student/guardian shall be conducted professionally and in a timely manner. Both parties agree to respond to messages, emails, or phone calls within a reasonable period.
12 - CHANGES TO AGREEMENT
12.1 - Amendment Procedure: Any changes or amendments to this tutoring contract must be made in writing and signed by both the tutor and the student/guardian.
12.2 - Notice of Changes: The Parties will be provided with at least 14 days' notice of any changes to the agreement.
13 - ENTIRE AGREEMENT
13.1 - Full Agreement: This tutoring contract represents the entire understanding between the tutor and the student/guardian and supersedes all prior agreements, whether written or oral. Any modifications or amendments to this agreement must be made in writing and signed by both Parties.
13.2 – By paying for a course, the student/guardian acknowledge that they have read, understood, and agreed to all the terms and conditions contained in this document.
